The terms for using the Respiro app.
These terms are the agreement between you and Amiko Srl for using the Respiro respiratory app and its connected inhaler sensor. Please read them, especially the part about what Respiro is, and is not, for.

About these terms
These terms are your agreement with Amiko Srl, Via Ruggiero Settimo 4, 20146 Milan, Italy, for using the Respiro app and compatible connected sensors. Sensor sales are covered separately by the seller’s terms. You accept these terms when creating your account; if you do not agree, do not use Respiro.
A healthcare programme, clinician or study may have additional terms and privacy information for its own services.
What Respiro is, and its limits
Respiro lets people with chronic respiratory disease, or their authorised caregivers, record and review inhaler use, symptoms and related entries alongside local environmental conditions. A compatible sensor can record inhalation events automatically and provide technique information. You can choose to share records with a healthcare provider. There are no known contraindications.
Classification. Respiro is not a medical device on its own. When used with a Respiro sensor, the app is classified as a CE Class I medical device under Regulation (EU) 2017/745 (MDR), in accordance with Article 51 and Annex VIII, Chapter III, Rule 11. This classification rests on its outputs being descriptive and not intended for diagnostic or therapeutic decision-making.
Information, not medical advice. Respiro does not provide medical advice, diagnosis or clinical recommendations and must not be used to make medical decisions. It does not replace professional advice. Always follow your prescribed treatment and your inhaler’s instructions. Technique information describes how the inhaler was operated; it does not measure lung function or establish whether medication was effective. Do not change a dose because of a technique result.
Breathing outlook describes local conditions over approximately the next 12 hours. It uses environmental information and pollen preferences; with a compatible sensor, it can also use your respiratory condition and sensor-recorded reliever use. Manual doses and symptom check-ins do not feed it. It does not assess condition control or predict an attack, and must not be used to change treatment.
Not for emergencies. If breathing becomes difficult, symptoms worsen or you suspect an emergency, seek urgent medical help. Never delay care because of something Respiro does or does not show. Report serious device incidents to Amiko and the competent authority in your country.
Who can use Respiro
Respiro asks for date of birth and country during account setup. Minors cannot create their own account. A parent, guardian or other person legally authorised to act for them must set up and manage their account through Respiro Hub and provide the required consent.
Availability depends on country, language and device compatibility. If you act for someone else, you must have the necessary authority and consent.
Your account
Provide accurate details, keep login credentials private and use a device passcode or biometric lock where possible. Use your own authorised account; caregivers use their Hub access rather than sharing another person’s credentials. Report suspected unauthorised access to support@respiro.io.
The app and sensor
Features depend on compatible phones, operating systems, inhalers and sensors. Sensor sync needs Bluetooth and relevant permissions. Features may be unavailable when a sensor is unpaired or out of battery, you are offline, or software is outdated.
Follow the inhaler and sensor instructions, keep the app updated, and do not modify, tamper with, reverse-engineer or repair the sensor unless authorised by Amiko or the supplier, except where applicable law permits.
Sensors are sold separately by manufacturing and distribution partners. For purchases, warranty service and returns, contact the seller in your purchase documents. This does not affect your statutory rights or Amiko’s responsibilities under applicable law.
App stores
Apple App Store or Google Play terms also apply to your download. Amiko is responsible for the app, its support and app-related claims, except where mandatory store terms say otherwise. These terms are Amiko’s end-user licence agreement.
Apple users. These terms are between you and Amiko, not Apple. Your licence covers Apple-branded devices you own or control, as the App Store usage rules allow. Apple need not provide maintenance or support. If the app fails to meet an applicable warranty, you may notify Apple for a refund of any app purchase price; beyond that, Amiko is responsible for applicable warranty, product, legal and intellectual-property claims. You must comply with applicable third-party terms and must not be located in a country subject to a U.S. Government embargo or listed as a restricted party by the U.S. Government. Apple and its subsidiaries are third-party beneficiaries and may enforce these terms against you.
Price
Respiro is free to download and use at launch. Some features may be provided through a healthcare or partner programme. Before any future paid feature or subscription purchase, we will show the price and applicable renewal, cancellation and refund terms.
Your data
The Privacy Policy explains how we use data and your rights. At sign-up, we ask for explicit consent to process health data. You can withdraw consent or request account deletion through Settings or privacy@amiko.io. Settings opens a request to us; the Privacy Policy explains how we handle it.
Withdrawing health-data consent closes the account because Respiro depends on that data. You can request a copy of your data first.
Connecting to a care programme or clinician
Connecting is your choice. Before you connect, we show what will be shared: up to the last 12 months of your Respiro history, plus ongoing data. The history window is fixed. The organisation handles received data under its own privacy notice.
You can stop future sharing at any time, although the organisation may retain data already received in its records. Connecting does not guarantee that a clinician is monitoring your records or will respond to them.
Acceptable use
Use Respiro lawfully and for its intended purpose. Do not access others’ accounts, interfere with or probe systems, introduce malicious code, bypass security, submit false information or scrape or bulk-export data without authority. Do not copy, modify or reverse-engineer the software, algorithms or models except where the law permits.
These restrictions do not prevent authorised data access or export, or the exercise of rights under law.
Intellectual property
Amiko and its licensors own the app, platform, algorithms, designs, trademarks and related intellectual property. You receive a limited, personal, non-transferable licence to use Respiro under these terms.
You keep your rights in the data you provide. We process personal data as explained in the Privacy Policy. We may use your feedback to improve Respiro without compensation.
Changes and availability
We may update Respiro to improve features, fix problems, maintain compatibility or meet security, legal and safety needs. We do not promise uninterrupted or error-free service.
We will give reasonable advance notice of material changes and their effective date, unless urgent legal or security reasons require an immediate change. You can stop using Respiro and request your data. Where required, we will obtain your agreement to new terms or your consent separately.
Ending your use
You can stop using Respiro at any time and request deletion or withdraw consent as described above. We may suspend or end access for serious or repeated breaches, security or safety needs, or legal requirements.
If we discontinue Respiro in your market, we will give reasonable advance notice and an opportunity to request your data, unless urgent legal or security reasons prevent this. The Privacy Policy explains data retention and deletion.
Warranties and liability
Respiro is provided in line with its documentation and these terms and, beyond that, on an “as is” and “as available” basis. We do not promise compatibility with every device or purpose.
Nothing limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, fraud or other non-excludable liability. Your mandatory consumer rights remain unaffected.
For other liability that the law allows us to limit, our total liability is capped at the greater of the amount you paid us for Respiro in the 12 months before the event giving rise to the claim, or €50.
Organisational and study use
Healthcare organisations, study sponsors, pharmaceutical companies, partners and developers use Respiro under separate written agreements, including relevant processing agreements, study protocols and participation documents. Those arrangements explain study-specific data use and do not remove your statutory rights.
Governing law
Italian law governs these terms without reducing mandatory protections under the law of your country of residence. Consumers retain their rights to use the courts available to them under consumer law. For other users, the courts of Milan have jurisdiction, subject to applicable law.
